Abstract

U svakom modernom pravnom uređenju sloboda je zajamčena svakom čovjeku te se smatra temeljnim ljudskim pravom. Sloboda se proučava s različitih aspekata, a u ovom radu istraživat će se pojam slobode s različitih aspekata, njezin povijesni razvoj kao i mogući utjecaj na sklapanje sakramenta ženidbe. Zakonik kanonskog prava iz 1983. posebnu pažnju posvećuje općim i temeljnim obvezama i pravima svih članova Katoličke Crkve, među kojima uređuje i pravo na slobodan izbor životnog staleža (kan. 219).... More Izbor vlastitog životnog staleža jest izbor između svjetovnog, kleričkog ili redovničkog života, te između ženidbe i celibata. Stoga takav izbor mora biti plod jedne slobodne, svjesne i promišljene odluke. Sloboda izbora je sveta, a kao takva ona se poštuje i pravno zaštićuje. Ona isključuje prisilu i nasilje, ali i svaki čin koji bi ju mogli spriječiti ili uvjetovati. Ženidba kao sakrament i ugovor u Katoličkoj Crkvi predstavlja svetu i trajnu zajednicu, ukorijenjenu u Božjoj ljubavi i milosti, s ciljem zajedničkog života usmjerenu prema dobru supruga te rađanju i odgajanju potomstva. Kanonsko pravo zbog neizmjerne važnosti te temeljne institucije društva uređuje kako zapreka otmice (kan. 1089), prisila i veliki strah (kan. 1103) utječu na valjano sklapanje ženidbe kao i kojim se pravno-pastoralnim sredstvima sloboda osobe štiti. Abstract (english)

In every modern legal system, freedom is guaranteed to every person and is considered a fundamental human right. Freedom is studied from different perspectives, and this paper will explore the concept of freedom from various angles, its historical development, as well as its possible impact on the sacrament of marriage. The Code of Canon Law from 1983 pays special attention to the general and fundamental obligations and rights of all members of the Catholic Church, among which it regulates the... More right to freely choose one's state of life (can. 219). The choice of one's state of life is a choice between secular, clerical, or religious life, and between marriage and celibacy. Therefore, such a choice must be the result of a free, conscious, and considered decision. The freedom of choice is sacred, and as such, it is respected and legally protected. It excludes coercion and violence, as well as any act that could prevent or condition it. Marriage as a sacrament and contract in the Catholic Church represents a holy and permanent union, rooted in God's love and grace, aimed at a common life directed toward the good of the spouses and the birth and upbringing of offspring. Due to the immense importance of this fundamental institution of society, Canon Law regulates how the impediments of abduction (can. 1089), coercion and grave fear (can. 1103) affect the valid contracting of marriage and what legal-pastoral means are used to protect a person's freedom.
